High Court revises ruling on creditors’ claim on joint bank accounts

Our Managing Director, Abraham Vergis, S.C., and Director, Mingguan Lim were recently successful in resisting final garnishee orders sought against joint bank accounts. This is the first reported case by the Singapore courts involving a show cause hearing after a provisional garnishee order was made, in a departure from precedent, against such joint accounts. This decision provides important guidance for banks, judgment creditors and joint account holders on how to manage potential enforcement proceedings against judgment debtors and joint bank accounts in their names.
