Rajiv Hariharan

Rajiv is a Counsel with the firm. He has acted in various commercial disputes, with a focus on contentious and non-contentious aspects of construction, infrastructure and energy matters.

Rajiv graduated from Monash University with an LL.B. (First Class Honours), where he achieved the best performance for Advanced Torts. Rajiv was also a Research Assistant with the Monash University Faculty of Law, where he assisted in writing casebooks relating to Commercial Law and Remedies.

Prior to joining Providence Law LLC, Rajiv practised as an Australian-qualified solicitor at a leading construction and infrastructure law firm in Melbourne, where he was involved in the conduct of large-scale arbitrations and provided ongoing advice to clients in relation to public infrastructure projects across Australia. Rajiv has also practised at a construction disputes boutique firm in Singapore, where he acted for specialist sub-contractors and multi-national companies in litigation, arbitration and adjudication proceedings. 

Rajiv is fluent in English and Tamil.

Professional Experience

  • Acted for a Project Company in AUD$1 billion tripartite ACICA arbitration proceedings against a State government and a main contractor, with a focus on defending claims for Extensions of Time, Liquidated Damages and Prolongation Costs.
  • Prosecuted claims on behalf of a market-leading Engineering, Procurement and Construction contractor against a State government in relation to a AUD$170 million renewable energy facility in New South Wales.
  • Acted for a bored piling contractor in a multi-million-dollar SIAC arbitration in relation to public desalination infrastructure in Singapore, with a particular focus on claims for under-certification of work and omission of work.
  • Acted for a multi-national corporation in an SIAC arbitration defending various claims and bringing counterclaims against a sub-contractor, including successfully conducting enforcement proceedings of the Award in the High Court of Singapore.
  • Advised a Project Company on ongoing contractual matters arising under a Public-Private Partnership delivery model during the Operation and Maintenance phase of a AUD$2 billion public hospital project in South Australia.
  • Advised a Project Company in relation to a potential dispute regarding the scope of works required under a AUD$3.9 billion contract for the construction of an underground motorway in New South Wales.
  • Advised a listed-company subsidiary in connection with ongoing claims arising against a Government body regarding tunneling and cabling works for the construction of Singapore’s longest integrated transport corridor.
  • Conducted adjudications under the Building and Construction Industry Security of Payment Act on behalf of specialist sub-contractors in relation to retail, residential and tourism projects.
